- Notify the insurer promptly. Contact the at-fault driver’s insurer as soon as practicable. If the at-fault vehicle is uninsured or fled the scene, contact MVACF (administered by FSRA) and, if you hold your own auto policy, your own insurer simultaneously.
- Request and complete the OCF forms. The insurer must provide an Application for Accident Benefits (OCF-1) and, where applicable, an Employer’s Confirmation (OCF-2) and Disability Certificate (OCF-3). Pedestrians and cyclists complete the same forms as occupants.
- Document injuries carefully. Seek medical attention immediately and ensure your healthcare provider records the mechanism of injury (struck as pedestrian/cyclist) — this is material to benefit eligibility and potential catastrophic designation.
- Keep records of all out-of-pocket expenses. Retain receipts for medication, mobility aids, and transportation to treatment, as these may be recoverable under the SABS.
Unidentified or Uninsured Drivers — The MVACF Safety Net
If the vehicle that struck you left the scene or carried no valid insurance, you are not without recourse. The Motor Vehicle Accident Claims Fund is a fund of last resort administered under the Motor Vehicle Accident Claims Act, R.S.O. 1990, c. M.41. To access MVACF:
- You must report the accident to police within 24 hours (or as soon as reasonably practicable);
- You must file an application with MVACF and demonstrate the vehicle was uninsured or unidentified;
- MVACF accident benefits mirror standard SABS entitlements but are subject to statutory limits.
Important: If you hold your own automobile policy as a named insured, dependent, or resident family member, your own insurer becomes the priority payer ahead of MVACF for accident benefits — always check your household’s insurance portfolio first.
Deadlines — Do Not Miss These for Pedestrian and Cyclist Claims
The same statutory deadlines that govern motorist claims apply to pedestrians and cyclists (see Critical Deadlines for Your Accident Benefits Claim above), but deserve emphasis here because non-motorists are often unaware they are even entitled to claim:

Missing the 7-day notice period does not automatically extinguish your claim, but unexplained delay can give an insurer grounds to dispute entitlement. Cyclists and pedestrians who are hospitalized or incapacitated should have a family member or legal representative notify the insurer on their behalf as soon as possible.
Tort Claims Run Alongside — But Are Separate
Claiming accident benefits does not prevent a pedestrian or cyclist from also pursuing a tort (negligence) claim against the at-fault driver for pain and suffering and other damages not covered by SABS. Tort claims in Ontario are subject to the statutory deductible and threshold described in Lawsuits, Pain and Suffering, and the Statutory Deductible above. The two streams — accident benefits and tort — are distinct proceedings, and accepting accident benefits does not constitute a release of tort rights.
Dependant Support Claims Under Ontario’s Succession Law Reform Act
Scope note: This section addresses a distinct area of estate law. While accident benefits flow from the Insurance Act and the Statutory Accident Benefits Schedule (SABS), dependant support claims arise under a separate statute and involve the courts, not an insurer’s claims process. If you are injured in a collision and have lost a financial provider, both regimes may be relevant to you simultaneously.
What Is a Dependant Support Claim?
Part V of Ontario’s Succession Law Reform Act, R.S.O. 1990, c. S.26 (SLRA), empowers a court to order that an estate provide adequate support for a dependant where the deceased—whether through a will or the rules of intestacy—failed to do so. The remedy does not void the entire estate plan; rather, it carves out the support amount the court considers appropriate and directs it to the qualifying claimant ahead of, or in priority over, other beneficiaries or creditors (subject to statutory limits).
This is not an accident benefit. It is not paid by an automobile insurer. It is a claim made against the estate itself, litigated in the Ontario Superior Court of Justice.
Who Qualifies as a Dependant Under the SLRA?
Section 57 of the SLRA sets out a two-part test for “dependant” status:
1. Relational eligibility — The claimant must fall within one of the following categories in relation to the deceased:
- Spouse (legally married or a qualifying common-law partner under the Act’s definition)
- Parent
- Child (including an adult child)
- Sibling
- Grandchild, in some circumstances
Common-law partners who cohabited continuously for at least three years, or who were in a relationship of some permanence and are the natural or adoptive parents of a child together, may also qualify as spouses for SLRA purposes.
2. Actual dependency — The claimant must have been financially dependent on the deceased at or near the time of death. A pre-existing legal obligation to support (e.g., a separation agreement, court order) can be relevant evidence, but is not strictly required. Courts look at whether the deceased was, in practice, providing financial support.
Key point: Having a family relationship alone is not enough. An adult child who was entirely self-sufficient will generally not meet the dependency threshold, though each case turns on its own facts.
How to File a Dependant Support Claim
Filing a dependant support claim involves several procedural steps under the SLRA and the Rules of Civil Procedure:

Identify the estate trustee (executor/administrator) — The claim is brought against the estate, represented by its trustee. If no trustee has been appointed, steps may first be needed to have one named.

Issue an application or action — Claims are typically commenced by Notice of Application in the Ontario Superior Court of Justice (Estates List in Toronto; general Superior Court elsewhere). The Application sets out the claimant’s relationship, the nature and extent of dependency, and the relief sought.

Serve all interested parties — Other beneficiaries and creditors with notice may be required to be served. Courts have broad discretion to add parties.

File supporting evidence — Financial disclosure is central: income, assets, expenses, and evidence of the deceased’s prior support are all relevant. Medical or vocational evidence may be needed if disability or incapacity is a factor.

Attempt resolution — Many matters resolve through negotiation or mediation before a full hearing. Estate trustees have authority to settle within the bounds of their fiduciary duty.

Court hearing — If unresolved, a judge weighs the evidence and may order a lump-sum or periodic support payment from the estate.
Factors Courts Consider When Awarding Dependant Support
Section 62 of the SLRA provides a non-exhaustive list of considerations. Courts commonly assess:

No single factor is determinative. Courts aim for an amount that is adequate and proper given all circumstances—not necessarily what the claimant desires.
Time Limits — Do Not Miss These
Ontario imposes a strict limitation period for dependant support claims:
- Six months from the grant of Certificate of Appointment of Estate Trustee (probate) — this is the primary deadline under s. 61(1) of the SLRA.
- If no certificate has been granted, the limitation runs from the date of death in some circumstances, and legal advice should be obtained promptly.
- Estate assets cannot be fully distributed by a trustee before six months have elapsed without the consent of dependants or a court order, precisely to protect potential claimants.
⚠️ Missing this deadline can permanently extinguish the claim. Unlike some civil limitation periods, courts have very limited discretion to extend the SLRA window once it has passed. If you believe you may have a dependant support claim, consult an estate litigation lawyer as soon as possible after a death.
